Terms & Conditions


1. Our Website

1.a. If you wish to purchase any Product’s or Item’s from us, it is best to do so from our website, in this instance you will be required to create an online/website account. If you do decide to use our website, you will be deemed to be accountable for ensuring that all information provided is always accurate and factual and maintained as we will rely on the information provided by you. In addition, you will ensure that specifically any changes such change of addresses or delivery address is checked for accuracy before any such order is placed. You will also be responsible for always maintaining the confidentiality of your account and your password. You must ensure that you have adequate security in place on both your computer/device and software prior to logging onto or website. You should also restrict access to your computer/device to always prevent unauthorised access to your account. Upon providing us information on the website, you in turn are deemed to be providing us all necessary consent (whether acting on your own behalf or on behalf of another person). As such, you agree to accept responsibility for all activities and payments that are undertaken within your account and password. You should take all necessary measures to ensure that your password is kept confidential and secure. Should you have any concerns or suspect any fraudulent activity, or suspect your password may have been compromised, you must contact us immediately.

1b. We do not guarantee that our website is secure from viruses or other external influences. Should you transfer or upload any viruses or worms of a destructive nature that causes any damage or inadvertently causes any direct loss of any monies to either ourselves or any other 3rd party, you may be held liable for returning any such loses. By attempting to unlawfully gain access to any information not deemed to be public, you will be deemed to be in breach of our Terms, as such any breach will also be a criminal offence under the Computer Misuse Act 1990. In such instances, we will report any such any breach to the relevant law enforcement authorities or agency, in such circumstances we will fully co-operate and disclose all information we have that is either relevant or requested from us.

1.c. You must be at least 18 years of age to place any orders or open an account with us.

1.d. Accounts are non-transferable, as such we do not condone or allow the transfer of any account/credit or prepaid funds to

any other account holder or 3rd party. To do so would be in breach of our terms and conditions.

 

2. Website & product information

2.a. Whilst we take steps to ensure that the information on the Website is accurate and complete, some of it may be supplied to us by third parties and we are therefore unable to check its accuracy. You are advised to verify the accuracy of any information before relying on it. Furthermore, due to the inherent nature of the Internet at times there can be errors, interruptions and delays which may occur in the service at any time. In such instances, we will not be held liable for any monies or time lost as a result, in addition we do not accept any liability arising from any inaccuracy of the information provided on our Website or interruption in availability.
2.b. If a fault occurs in the service of our Website, you should report it to sales@dogtreats4u.co.uk immediately.

2.c. Your access to our website may be occasionally restricted due to repairs or maintenance etc. If you encounter this please contact us at sales@dogtreats4u.co.uk and we will aim to assist you with your enquiry or order

2.d. While we always aim to ensure that the material and information provided on our website is kept up to date in regards to the product’s/good’s that we sell, the images of the products are for illustrative purposes only as there may be instances where a manufacturer/supplier may have changed their product or packaging. Therefore, we make no warranties or guarantees (whether express or implied) in relation to the accuracy of any displayed information. Please always refer to the product packaging for the most up to date copy of the product's ingredients. Any reliance on the material is at your own risk. It is the consumers responsibility to ensure that all products are safe for consumption before they are consumed. If you are unsure about the welfare or safety of any item or product you should consult and seek advice with your vet in the first instance. In all instances, should you wish to return any items/products, please our Refunds policy.

2.e. Whilst we provide images of our items/products, the images are only for Illustrative purposes only. We do not guarantee that a product/item will be the same as the images seen on our website.

2.f The Product’s or Item’s that you purchase from us are made for dogs only and may not be safe for human consumption.

2.g. The Welfare and Safety for your dog is of the upmost importance to us, however due to the variety of dog breeds, ages and sizes we will always leave the responsibility with the customer or owner to ensure that any food items are appropriate to the dog they are feeding. Each dog is unique and therefore on occasions a Product’s or Item’s may not be suitable for certain individual dogs. Therefore, upon receipt of your order, please ensure that you are confident that the product you have purchased will in fact is suitable for your dog. If you are unsure, please refer to our refund policy and eligibility of such items.

2.h. The products/items that we sell and provide may contain allergens, if your pet has any allergies, you may wish to consult a veterinary expert before the products/items are handled. It is your responsibility to ensure that any products/items are safe for consummation or to handle by your pet in the first instance. We will not be held liable if your pet has a reaction to any of our products/items. Should you have any concerns, you should not purchase any such product or Item. Please be sure to always refer to the product packaging for the most up to date copy of the product's ingredients.

2.i. The products/items that we sell and provide are often natural and perishable and therefore you should always follow the storage guidelines on the packaging of the product/item purchased. If your item/product is missing its label for any reason you should contact us immediately and we will provide you with the specific guidance. Once the Product or Item is delivered to you, it is your responsibility to take ownership of how the item/product is stored.

2.j There will be no information provided to you by Us or any of our representatives, that should be taken as medical advice. Please consult your vet or an expert if you have any concerns or questions about the health of your pet or suitability of one our Item’s or product’s.


3. Promotions

3.a. On occasions, Dog Treats 4 U and other third parties may include competitions, promotions, vouchers or other offers either on our website or the packaging itself. Each offer or voucher shall be subject to its own individual terms and will be always subject to availability. No one order will be allowed to use or validate more than one voucher at any given time. If we have reasonable belief that you have redeemed or sourced a discount that you were not eligible for, you will be deemed to be in breach of our Terms & Conditions. In this instance any such discount will be removed before despatch and you will be charged for the difference in monies using the same payment means for the remainder of the order. However, your statutory rights will not be affected.

 

4. Welfare of our staff

4.a. Dog Treats 4 U will not accept any form of offensive or abusive language whether this be written or verbal. If this is experienced, all communication will cease immediately, and the consumer will void any rights to a refund or financial loss at any given such time throughout the contract or agreement with us. If the customer is within contract or has a subscription with us, any such agreement will be terminated immediately.


5. Account Closure or Refusal

5.a. Dog Treats 4 U reserve the right to decline or refuse your account application and/or suspend or terminate an existing account at any such time if you breach any of our Terms and Conditions which you will be bound by upon purchasing a product.

5.b. Should you wish to cancel or close your account with us, we ask that you e-mail sales@dogs4u.co.uk and we will aim to close your account within 28 days of the received communication. If any Product’s or Items are dispatched within this time frame you will continue to be charged. In such instances, please refer to our refund policy.

5.C. If you breach any of our Terms & Conditions then your account may be terminated or suspended immediately and no notice or refund will be issued to you.


6. Ordering Terms

6.a. All orders, purchases or subscriptions will be deemed to be in an agreement of our Terms & Conditions upon our acceptance of the order. 
6.b. When an order is confirmed on our Website, you should receive a confirmation email from us. It is your responsibility to check the items ordered and inform us if there is any discrepancy regarding either the product/quantity or price by the next working day. Your successful order and therefore contract will only be deemed to have been accepted by us upon your despatch confirmation being issued to the e-mail address provided on your account by you. The sale/contract will only relate to the Product’s or Item’s that we have dispatched, any items ordered but not dispatched will be either placed on back order or refunded, in either circumstance you will be notified.

6.c. At times there may be a supply issue with the product's that you may have ordered from us, in these instances Dog Treats 4 U reserve the right to supply you with a similar product to an equal or higher value of product/item that was ordered. In this instance you can rest assured that we have made every effort to satisfy you order with us. Should you not be happy with any Replacement product/item (only) you can return it for a Full Refund within 28 days of receipt (Please see our Refund Policy’s section 10. for further information). 


7. Pricing and Payments

7.a. In accordance with clause 6.b It is your responsibility to check the items ordered and inform us if there is any discrepancy regarding either the product/quantity or price by the next working day.

7.b. In the event that an overpayment has been processed and you have informed us in accordance with clause 6.b, we will return either the difference or issue a full refund within 14 working days from the day you placed the order.

7.c. All prices displayed on the Website are inclusive of VAT.

7.d. When an order value does not qualify for free delivery, a delivery charge will be applicable and confirmed at checkout.  

7.e. It is your responsibility to ensure that the amount being charged to You, is valid and always correct.

7.f. If your payment/transaction is not successful at the time of order/dispatch, then we reserve the right to withhold your order/items.

7.g. Upon attempts by us to process or receive any such outstanding monies owed by you, by no later than 28 days from the time of delivery may result in further action by us. We therefore reserve the right to appoint a 3rd party debt management company to recover any such outstanding costs at any such time where there is an outstanding balance/arrears by you, if such action takes place you will also be liable for any additional costs or fees applied by the 3rd party debt management company in an effort to recover All outstanding funds owing at any given time until such time when all outstanding arrears/debts have been settled in full.

7.h. You will not make any charge backs or raise any disputes with your credit/debit card company or bank provider that results in a loss or withheld funds to Dog Treats 4 U without providing us a minimum of 14 days to settle any such dispute or concerns that you may concerning any of our products/items/services, during this time We will aim to settle any such complaint/dispute. 

 

8. Delivery timings

8.a. We will always aim to have your delivery received within 14 working days of the day that the order was placed. However, whilst we will aim to source reliable and proven delivery means of your items, there may be times when either a delay is caused outside of our control, or even that your items may have got lost. If you have not received your items within 7 days of placing the order, please contact sales@dogtreats4u.co.uk so we can investigate further and not impose any further delays against our delivery times.

 

9. Consumer Rights

9.a. You have the right to cancel your subscription/contract with us at any time within 28 days of placing and paying for any such order, providing that either the part or full order has not been despatched from us. If any such items have been despatched that you wish to cancel, then please contact us at sales@dogtreats4u.co.uk and request a refund, at which time you should refer to our refund policy.

 

10. Dog Treats 4 U Refund Policy

10.a. When returning an unwanted product’s/good’s, we require product’s/good’s to be registered with us in the first instance,   this must be completed within 28 days of the product’s/good’s being delivered. Upon us acknowledging the return, you will be provided with a returns form, the completed returns form must be accompanied with the unwanted product’s/good’s when returning to us, otherwise we may not be able to identify the return upon receipt. Upon the successful receipt of such items, we will aim to process the refund within 28 days. However, in the instance that you have purchased a perishable item, your rights under the Consumer Contracts Regulations 2013 (article 6:230p) will not apply to any such order/product’s/good’s that you may have placed with us. In this instance, you will not be able to return the product’s/good’s that you have purchased from us, unless the items or product(s) are defective, in this instance please clause 10.c.

10.b. In accordance with clause 10.a. It is Important to note that we will not be held liable for any return costs that you may incur upon returning the items to us and neither will any such costs be refunded either, unless the product’s/good’s is faulty or defective, see clause 10.c.

10.c. In the event that any product’s/goods are defective or faulty, You legally have up to 30 days to return any such product’s/Item’s to Us. We reserve the right to examine the returned items upon receipt in the 1st instance. Once received we will confirm with you via the email address that you provided us upon placing the order, this will be carried out within a reasonable period. We will then refund the purchase price only within 30 working days of the day that we receive back the defective items. Items returned because of a defect will typically include a refund of any such delivery/postal charges that you may have incurred as a result upon returning the item to us. However, it is important to note that in all instances we reserve the right to firstly provide you with n 3rd party collection service before hand.

10.d. We recommend upon returning any product’s/good’s to us, that you ensure that you do so using a Postal ‘tracking service’. We will not be held liable for any refund or return of any monies until the items have not been received to us.

10.e. In the case of returns pursuant to clause 10.b, in relation to the return of any product’s/goods, unless the product’s/goods are being returned to us as either faulty or defective, we reserve the right to deduct the value/amount of the monies being refunded to you if any costs have been incurred by us upon the receipt/return of the product’s/good’s from you, as a result of inadequate post, delivery or logistic fees.

10.f. Any items received outside of our returns policy may receive a credit against their website/online account where we believe that You have taken all necessary steps/measures to ensure that any product’s/good’s have been returned in accordance with our terms, however may have been delayed due to external influences outside of your control.

10.g. In pursuant to clause 10.f, all items that are legible for a refund will usually be refunded using the same method originally used by you to pay for your purchase.

 

11. Risk & Ownership Rights

11.a. All product’s/good’s received from us will be deemed to be in your ownership from the time of receipt, at this time you will take full responsibility for the product’s/goods. 

 

12. Our Liability To You

12.a. We will always aim to provide you product’s/good’s that are satisfactory/quality and reasonably fit for purpose for which the good’s/products are commonly supplied or used for.

12.b. We will not be held responsible or accountable to you or any third party whether in contract, tort (including negligence) or otherwise for incidental, special, indirect or consequential loss or damage, any loss of profit (direct or indirect), loss of sales, loss of goodwill or reputation, loss of business, third party claims, pure economic loss arising out of or in connection of the performance or non-performance of our obligations under these Terms and Conditions, including such damage as may be reasonably foreseeable at the date you order the product’s/good’s from Us.12.c. Whether you are contracting with us as a business or as a consumer, our liability for any claim for loss or damage shall only be limited to the purchase price of the product’s/good’s that were ordered/purchased from us.

 

13. Limitations of liability

13.a. Nothing in our Terms and Conditions shall exclude nor limit us for any liability for losses which may not lawfully be excluded or limited by applicable law.13.b. Furthermore, we shall not be liable for any damage, claim, loss nor any indirect, special, incidental or consequential damages of any kind, whether based in contract or otherwise, which may arise from the use of our website, or the unauthorised access to either yours or our data, even if we have been advised or recommended otherwise.

 

14. Your Liability To Us

14.a. To ensure that you have fully read our Terms & Conditions before you place any order or depart with any monies. Once you have placed an order, you will be deemed to have legally agreed with our Terms & Conditions of the sale and will be accountable to always uphold the agreement.

14.b. If you are unhappy with a compliant or an outcome that we have provided, or if both parties are unable to reach a resolution, then you may wish to seek independent help and advice. Your local Citizens Advice Bureau may be able to help you. We will consider all recommendations provided by the Citizens Advice Bureau in such circumstances.

14.c. Before taking any court proceedings, outside of this agreement, all parties involved will attempt to resolve all matters informally in the first instance. At this time the disputing party should inform us of the issue or grievance, providing as much detail as possible and allow for us to provide a reply which may take up to 28 days upon receipt of the grievance or complaint. If the dispute is not agreed to within a reasonable time, You or We can raise any such dispute to a UK court thereafter.

14.d. Be advised that our Terms of sale are subject are governed and enforced by UK law. Providing you have followed our escalation procedures, you and we both agree that the appropriate UK court’s will then enforce the final jurisdiction in the event that neither parties can agree on any such dispute.


15. Communications

15.a. For contractual purposes, you agree and acknowledge that all contracts, notices, information and other communications will be provided to you electronically, unless we deem otherwise due to unforeseen circumstances. In instances where Good’s/Product’s are sold without the use of an online/website account then a written receipt or Invoice may be applicable upon purchasing good’s/Product’s from us. This is typical to when purchasing a product from us at public events such as Markets, stalls and other venues. This condition does not affect your statutory rights providing you retain your proof of purchase.

15.b. Upon registering an account with us, you are agreeing to receive emails promoting any special offer(s),communication which may include third party offers. In addition to the above, we reserve the right to send you our monthly newsletter. 

15.c. If you wish to, you may decide to opt-out from receiving our promotional e-mails and newsletters etc. In this event, please use the unsubscribe feature, or you can contact us direct at sales@dogtreats4U.co.uk


16. Events outside our control

16.a. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control.

16.b. This includes any act, event, non-happening, omission or accident beyond our reasonable control and includes such instances as strikes, lock-outs or other industrial action, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war or threat or preparation for war, fire, explosion, any inclement weather including storms, flood, earthquake, subsidence, epidemic or other natural disaster, inability of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

16.c. This includes any of our suppliers discontinuing any item’s/product’s displayed or sold on our website that we have no control over.

16.d. This includes the use of public or private telecommunications networks or Systems affected as a result of computer hacking or virus.

16.e. This includes our performance under any Contract is deemed to be suspended for the period that any of the above perils or occurrences may take place and continue for the duration of that period.

16.f. This includes any acts of decrees, legislation, regulations or restrictions of any government. 

16.g. All of our Products are made for the consumption of Dogs only.  It is Your responsibility to ensure that You follow the Feeding Instructions provided. We Always recommend that you supervise your dog/pet during and after the consumption of any and all of our products/items and ensure that the products/items that you are providing your dog/pet are not only safe and appropriate, but also that the size of the product/items are suitable to the size of the dog/pet. You must always ensure  that there is always fresh and clean water readily available. Always keep keep out of reach from Children. You should also ensure that you feed your Dog/Pet in a stain resistant area as We, will not take any responsibility for any damage caused from any of our products/items.

 

17. Waiver

17.a. The failure by us to at any time during the term of any Contract between us, to carry out our responsibilities and obligations to any of our terms and conditions shall not constitute as a waiver of such rights or remedies and shall not relieve you from compliance and your obligations to us.

17.b. A waiver by us of any fault or default shall not constitute a waiver, unless it is expressly stated to be a waiver and is communicated to you in writing.


18. General

18.a. The use of the Website and any Contracts formed between us are governed by UK law. Any dispute arising from, or related to, such use and any such Contracts shall be subject to the exclusive jurisdiction of the courts of the UK. We make no promise that materials on the Website are appropriate or available for use in locations outside the United Kingdom and accessing the Website from territories where its contents are illegal or unlawful is prohibited. If you choose to access the Website from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws. Overseas orders (i.e. orders from outside the United Kingdom) will not be accepted.

18.b A person who is not a party to these Terms and Conditions or any Contract between us shall have no right to enforce any term of the Terms and Conditions and/or any and/or all Contracts between us under the Contracts (Rights of Third Parties) Act 1999.

18.c. If any provision of these Terms and Conditions or any provisions of any Contract between us are found to be invalid or unlawful or unenforceable by a either us or a UK court to any extent, any given such provision will not invalidate any other remaining provisions, which will continue to be valid to the fullest extent permitted within UK or governing law.

18.d. We may assign, charge or transfer any of our rights or subcontract any of our obligations under these Terms and Conditions or any Contract to any third party at any time.

18.e. You may not assign, charge or transfer any of your rights or subcontract any of your obligations under these Terms and Conditions and/or any Contract between us, except with our specific prior written permission in writing beforehand. By doing so, you will be deemed to be in breach with the Terms of the contract with us.

18.f We reserve the right to revise and amend these Terms and Conditions from time to time and any such changes will be reflected within our Terms & Conditions on our website. You will be subject to the policies and the Terms and Conditions in force at the time that you purchase any product’s/good’s from us, unless any change to those policies or the Terms and Conditions is required to be made by law or governmental authority. If you do not wish to accept our new Terms and Conditions, you should not place an order/purchase from us or enter any such contractual agreement with us.

18.g. These Terms and Conditions govern the entire trading relationship between us and you and will remain in force for the duration of our trading relationship.

18.h.  In relation to the Storage of Products. You must adhere to the advice and guidance to the storage of each specific item. If the product(s) do not have storage guidelines contained on the label or packaging, then please ensure that the item is stored within a cool dark space. However, in every instance it will be the customers responsibility to contact Us for further advice if the product is missing its specific storage guidelines.
 
 

19. Delivery’s

19.a.  We only deliver to most areas within England, Wales and Scotland. However, we do not deliver to PO Boxes & BFPO addresses, Ireland, Northern Ireland, Isle of man, Chanel Islands. Should you place an order to a delivery address that we do not deliver to, we will in such instances return the full monies paid to us within 28 days. It is your responsibility to ensure that accurate and any additional notes required for delivery are provided upon ordering with us. Should your order/delivery not have been successful due to any special requirements that you had not made us aware of, we will not be held liable for any damages or costs incurred.

19.b. At the time of delivery, if no one is able to accept the delivery then the Item’s/Product’s will be left in the closest area, if there is a safe place then please ensure that you detail this when placing the order. We take no liability for any missing item’s/ Product’s/Parcel’s/Packages after they have been delivered to the address provided by You.

19.c. We are unable to re-schedule any orders once they leave us in transit. It is your responsibility to be at the delivery address upon delivery of the items or to take responsibility for the safe place provided.

19.d. If your courier is unable to deliver, they should inform you accordingly. At this time you can then contact them directly to re-arrange the delivery.

19.e. If you do not re-arrange your missed delivery, your items may be returned to us, upon the successful receipt of your items you will be notified. You will then be provided an opportunity to have them resent at an additional cost to you, or they will be refunded in accordance with our Refund Policy. 

19.f.  If you do not receive your delivery within 7 days of placing the order or your expected date of receipt, You must contact sales@dogtreats4u.co.uk and provide a reasonable amount of time to allow us to investigate further and not impose any further delays against our delivery times in accordance with clause 8

19.g. All Postal orders will arrive in a postal box and will be sealed with a Tamper proof seal, if this seal is broken upon arrival then No items should be handled or consumed. In the unlikelihood of this happening, You must report the broken tamper seal on the same day of Delivery to sales@dogtreats4u.co.uk You will then be required to return the order to Us. You’re your notification You will be provided a confirmation e-mail from Us detailing the Next Steps. You will be provided with an option for either a replacement or a full refund. A Returns & Pre-Paid postage Label will be provided to You by Us for the return of the order, upon return of the product’s Only we will facilitate either Your replacement product’s or Refund. Please note that We will not reimburse any costs paid by You for returning any products. Nor can we facilitate either Your replacement products or Refund until we have physically received your product’s back to Us. See Clause 10. For all FAQ regarding our Refund Policy.

 

20. Subscriptions Services of Product’s/Good’s

21.a. All of our subscriptions services including the product’s/good’s are bound to our terms and conditions but should take particular notice to all clauses below.

21.b. Upon successfully subscribing to one of our subscription plans, you will be subscribing to a repeat service of the chosen product’s/good’s by you. The product’s/good’s will be provided to you by us or via one of our recommended suppliers, all products will be despatched to you within a reasonable time frame of any given time or period chosen by you upon agreeing to purchase from our subscription page in accordance with our Terms & Conditions. Furthermore, we reserve the right to refuse and cancel any product’s/good’s that you subscribe/order with us. We may at any time limit or even cancel the product’s/good’s purchased or subscribed to by you.

21.c. To start your continuing monthly subscription service with us, you must in the first instance register an account with us. Upon doing so you will be agreeing to provide us and also maintain at all times accurate and truthful information regarding your billing information, your shipping information, email address and all other aspects of your account profile. All information that you provide to us, will be subject to our Privacy Policy.  Our acceptance of your order will take affect once we have emailed you, at this time a contractual agreement will take affect between you and us.

21.d. Once you have created an account with us you will be deemed to have accepted our Terms & Conditions. Once you have confirmed the Product’s/item’s that you wish to purchase, you will then select the time frame of when you would like the product to arrive. We purchase and sell products and items not just limited from the UK but from around the world, at times we may experience delays or cancelation of items displayed on our website, not only limited in accordance to clause’s 16 which you may be relevant your order or subscription with us. We reserve the right to ship you a package with other product’s/good’s should your selected Product’s/item’s not be in stock at the time of dispatch. In such instances, similar or common items will still need to be checked prior to use in accordance with Clause 2. Once your selected/desired product’s/good’s are back in stock with us, your service will be resumed as expected. If a product is discontinued and an alternative cannot be sourced, we will notify you within 28 days of your expected arrival date, using the e-mail address provided by you.

21.e. By subscribing with us, you are entering a legally binding contract and therefore agreeing to provide us consent to charge your registered credit/debit card or payment method, to value of the agreed amount of your subscription/contract at any time, unless communicated to you, by us before hand by giving no less than 28 days’ notice of your scheduled payment date. Please be advised Your fees may be subject to an increase.  

21.f. Making changes to your Subscription can be completed via your online/website account with us, or by e-mailing us at sales@dogtreats4u.co.uk at least 28 days before the Product’s/items are scheduled to be despatched. If you do not provide this notice, then You will continue to risk being charged the subscribed and contracted amount.

21.g. Upon ageing to a subscription service, it is your responsibility to ensure that there are sufficient funds within your registered payment method/bank or Credit or Debit card to allow our payment to be withdrawn.

21.h. Please note, upon agreement from you to use our subscription service, you will be agreeing to our terms and conditions.

21.i. We reserve the right to end the contract/subscription at any time. In most instances this will only take affect if you breach one of our Terms & Conditions or should we cease trading.

21.J. When a quantity is referred to within a selection/subscription pack, the quantity will represent the amount of individual items contained within. A pack that includes several items within will not represent as a single quantity item.

 

22. Who we are
